Terms and Conditions of Participation in the NISSIN competition Win & Celebrate

hereinafter referred to as “Nissin”.

2. ELIGIBLE PARTICIPANTS
Any natural person who is over 18 years of age at the time of participation and who is a resident in the European Union is eligible to participate. Generally excluded are employees of Nissin Foods GmbH, Nissin Foods Kft. and their relatives.

3. PARTICIPATION

The competition is free of charge.

How to participate:

To participate, the QR code must be scanned in participating food retail markets during the set timeframe of the competition (campaign period). The participant will then be automatically redirected to the competition website and must enter all requested data, including the scanned QR code, on the website in order to participate in the competition.

Alternatively, it is also possible to enter the competition without a QR code by accessing the competition landing page https://de.nissin-foods.eu/cupnoodles/win-and-celebrate or via selected Nissin social media channels linking to the landing page. This also requires entering all the requested data on the website

Participation is not permitted via lottery services or automated, third-party mass participation methods.

4. CAMPAIGN PERIOD

The Cup Noodles competition will take place during the campaign period of 1 October 2022 to 31 March 2023.

The closing date for entries is 31 March 2023 (the date of contact form submission on the landing page is decisive).

5. WINS

As part of the Win & Celebrate competition, the following prizes will be raffled off among all participants:

  • Grand prize: 5 trips to London for the London Matsuri Festival: The prize is a short trip to London for 2 people (individual trip), including a visit to the Matsuri Festival. The trip is expected to take place in September 2023. The binding date will be set by the organiser together with the winner. Further details of the trip will be communicated after the winner has been determined. The winner accepts any necessary changes to the prize due to circumstances beyond the control of the Organiser.
  • 15 Teppanyaki grills
  • 150 decorative lanterns

 

6. DETERMINATION OF WINNERS

The winners will be determined by drawing lots from among all persons who have submitted the requested data completely and correctly on the website and who meet the terms and conditions of participation set out herein. The winners will be notified of their prize by e-mail from 1 April 2023 at the earliest to 31 May 2023 at the latest.

A winner has no right to substitute a prize for cash or any other alternative under any circumstance. A winner’s claim to a prize or substitution is highly personal and cannot be assigned or otherwise transferred to another party.

If, following notification of a win, no response with a shipping address is received from the winner within 5 working days (via message to Nissin/the agency commissioned by Nissin), the respective claim to the prize will lapse. In this case, Nissin is entitled to draw alternative winners from among the participants.

Participants are responsible for the accuracy of the contact details provided. Nissin accepts no liability for the timeliness, completeness or accuracy of the transmission of participation data. Should the contact data provided be incorrect, Nissin is not obliged to determine correct addresses. Any disadvantages resulting from the provision of incorrect contact data shall be borne by the participants.

Legal recourse is excluded. 


7. EXCLUSION FROM PARTICIPATION

Nissin has the right to exclude participants who manipulate or attempt to manipulate the entry process and/or the competition or who violate these terms and conditions of participation, including all cases of illegal hacking in particular.

8. NON-GUARANTEE/PREMATURE TERMINATION

Nissin explicitly does not guarantee the availability and functionality of the competition. The competition may be terminated or removed due to external circumstances or constraints without giving rise to any claim by participants against Nissin. This may include technical problems, rule changes or official or judicial decisions.

Nissin reserves the right to cancel the competition without notice and to terminate it without giving any reason.

9. DATA PROTECTION INFORMATION/RIGHTS OF THE PARTICIPANTS

Nissin is the responsible party within the meaning of the General Data Protection Regulation (GDPR) for the collection and processing of personal data in connection with the competition. The personal participant data provided as part of the competition (namely: form of address, first name, surname, address and any photo or text data) will be stored and processed exclusively for the purpose of carrying out and processing the competition by:

Personal data will only be passed on to service providers commissioned by Nissin (e.g. Alex & Groß GmbH) as well as the agency commissioned by it and, if applicable, the organisers of the trip or airlines. The data will only be passed on for the purpose of carrying out the competition and processing the prize.

The legal basis for data processing is Art. 6 (1) lit. b) GDPR.

RIGHTS OF THE PARTICIPANTS

A participant has the right at any time to request information free of charge about the personal data stored, its origin, its recipients and the data processing purposes. Furthermore, the participant is entitled to demand that personal data be corrected, blocked or deleted. Participants may also object to the processing of their personal data and lodge a complaint with the competent data protection authorities at any time. Participants’ data will be deleted following the end of the competition and its completion.

10. LIABILITY

Nissin, its entities, employees or vicarious agents are in principle liable in accordance with the statutory provisions for damages arising from or in connection with the competition, unless the following provisions provide otherwise.

Nissin, its officers, employees or agents shall be liable without limitation for any loss or damage caused by Nissin, its officers, employees or agents intentionally or through gross negligence. Nissin, its entities, employees or vicarious agents are furthermore liable without limitation on the basis of mandatory statutory provisions.

Nissin, its entities, employees or vicarious agents are always liable without limitation for damages in cases of injury to life, body or health.

Liability for losses or infringements of rights resulting from slight negligence due to breach of essential obligations (essential obligations are obligations that are indispensable for the proper performance of the legal relationship and on the performance of which the other party can generally rely) shall be limited to compensation for typical and foreseeable damage. In all other cases, liability for slight negligence is excluded.

This does not affect any direct liability of the airlines and/or tour operators according to relevant statutory provisions.

11. APPLICABLE LAW

Participation in this competition and the resulting legal relationships between the participants and Nissin, including these terms and conditions of participation, are governed exclusively by the laws of the Federal Republic of Germany. In the case of consumers, this choice of law only applies insofar as the protection granted to them is not withdrawn by mandatory provisions of the law of the country in which they have their habitual residence.
