Terms and conditions of participation

2. ELIGIBLE PARTICIPANTS

All natural persons who are over 18 years of age at the time of participation and who reside within the European Union are eligible to participate. Employees of the Organiser and their relatives – and/or companies affiliated with the Organiser – are excluded from participation.

3. PARTICIPATION

Here’s how you can take part and win:

Buy at least one Takumi Ramen Masters product at a store or online (via Amazon). Scan the QR code at the point of sale (wobbler, tear-off block or product display) or enter the URL www.cupnoodles.de/takumiraffle to go to the competition website. Enter your first and last name, address and email, and upload your receipt or invoice (photo or scan) or post it to the Organiser’s address.

By participating, you accept the above conditions of participation.

It is only possible to participate once.

4. WIN

The prizes are:

The MAIN PRIZE: 50 x original Japanese chef’s knives, including one year of free re-sharpening service from Kinya Terada, an artisan based in Frankfurt am Main.

Additional prizes: 100 Takumi product boxes.

5. PERIOD OF PROMOTIONAL SWEEPSTAKES

Sweepstakes promotional period: 1 June to 31 October 2021. THE DEADLINE for PARTICIPATION is 31 October 2021. (date of upload or postmark).

6. ANNOUNCEMENT OF WINNERS

Following the end of the promotional period, the winners will be selected by lot from among all participants who correctly uploaded or sent a verified receipt/invoice to the Organiser. Winners will be notified via email by 30 November 2021.

The prizes will be sent to the winners’ private addresses.

It is not possible to receive payment in cash, nor to exchange or transfer the prize to third parties.

The Organiser is entitled to select alternative winners in the event that a winner or winners decline a prize.

Participants are responsible for the accuracy of their contact details provided. The Organiser accepts no liability for the timeliness, completeness or accuracy of the transmission of participation data. If the provided contact data is incorrect, the Organiser is not obliged to determine correct addresses. Any disadvantages resulting from the provision of incorrect contact data shall be borne by the participants.

In the event of a disputed registration, the authorised account holder of the e-mail address provided for registration shall be deemed as the participant. The authorised account holder is the natural person who has been assigned an email address by an ISP, online service or other organisation responsible for assigning email addresses for the domain associated with the specified address. The potential winner may be required to prove that he/she is the authorised account holder.

THE JUDGES’ DECISION IS FINAL.

7. EXCLUSION FROM THE COMPETITION

The Organiser has the right to exclude any entrant who tampers or attempts to tamper with the entry process and/or the competition, or who breaches these Terms and Conditions of Participation, including, without limitation, any case of unlawful hacking.

8. EXCLUSION OF WARRANTY/EARLY TERMINATION

The Organiser points out that the availability and function of the competition cannot be guaranteed. The competition may be terminated or cancelled due to external circumstances or constraints without resulting in any claims by participants against the Organiser. This may include technical problems, rule changes, or official or judicial decisions.

The Organiser reserves the right to cancel the sweepstakes without notice and to terminate it without giving any reason.

9. DATA PROTECTION INFORMATION/RIGHTS OF THE PARTICIPANTS

The Organiser is the responsible party within the meaning of the GDPR for the collection and processing of personal data in connection with the competition. The personal data of the participants provided as part of the participation – form of address, first name, surname, address and e-mail address, as well as photographic or text data (proof of purchase) – will be stored and processed exclusively for the purpose of carrying out and processing the sweepstakes by:

Personal data will only be passed on to service providers commissioned by us (e.g. Alex & Groß GmbH). The data will only be passed on for the purpose of carrying out the competition and processing the prize.

The legal basis for data processing is Art. 6 (1) lit. b) GDPR.

Rights of the participants:

You can object to the use of your data for advertising purposes at any time.

The participants’ data will be deleted after the end of the competition and its completion.

10. LIABILITY

The Organiser, its organs, employees, or vicarious agents are liable in principle in accordance with the statutory provisions for damages arising from or in connection with the sweepstakes, unless the following provisions provide otherwise.

The Organiser, its organs, employees or vicarious agents shall be liable without limitation for any loss or damage caused by the Organiser, its legal representatives or vicarious agents intentionally or through gross negligence. The Organiser, its organs, employees, or vicarious agents shall furthermore be liable without limitation on the basis of mandatory statutory provisions.

The Organiser, its organs, employees, or vicarious agents shall always be liable without limitation for damages in cases of injury to life, body, or health.

Liability for losses or infringements of rights resulting from slight negligence due to breach of essential obligations (essential obligations are obligations that are indispensable for the proper performance of the legal relationship and on the performance of which the other party can generally rely) shall be limited to compensation for typical and foreseeable damage. In all other cases, liability for slight negligence is excluded.

11. APPLICABLE LAW

Participation in this competition and the resulting legal relationships between participants and the Organiser, including these Terms and Conditions of Participation, are exclusively subject to the laws of the Federal Republic of Germany.
